Waste Disposal Bermondsey Service Terms and Conditions

These Terms and Conditions set out the basis on which Waste Disposal Bermondsey provides waste collection and disposal services to domestic and commercial customers. By placing a booking, confirming a collection, or otherwise using our waste services, you agree to be bound by these Terms and Conditions.

If you do not agree with any part of these terms, you should not proceed with a booking or use our services. You are responsible for ensuring that any person on whose behalf you make a booking has read and understood these Terms and Conditions.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means the person, business, or organisation requesting or paying for the waste collection and disposal service.

Service means any waste collection, removal, transportation, recycling, or disposal service provided by Waste Disposal Bermondsey.

Waste means any materials presented for collection by the Customer, including general household waste, commercial waste, recyclables, and bulky items, but excluding any prohibited or hazardous items as set out in these terms.

Agreement means the contract between Waste Disposal Bermondsey and the Customer comprising these Terms and Conditions and any specific details agreed at the time of booking.

Site means the address or location where the waste is to be collected.

2. Scope of Service

Waste Disposal Bermondsey provides waste collection and disposal services within its operational service area, including Bermondsey and surrounding locations. Availability of services may vary depending on the type and volume of waste, access to the Site, and local regulations.

The exact service to be provided, including the type of waste, estimated volume, collection date, and price, will be confirmed at the time of booking. Any information provided by the Customer regarding the quantity or type of waste must be accurate to ensure correct pricing and vehicle allocation.

3. Booking Process

3.1 Bookings may be made by telephone, email, or through an online request form if available. The Agreement is formed when Waste Disposal Bermondsey confirms acceptance of the booking, verbally or in writing.

3.2 At the time of booking, the Customer will be asked to provide details including name, contact information, Site address, description of the waste, access details, preferred collection date and time window, and any specific requirements.

3.3 All bookings are subject to availability. Waste Disposal Bermondsey reserves the right to refuse or cancel any booking where the Site is outside the service area, the waste type is prohibited, or the required resources are not available.

3.4 The Customer is responsible for ensuring that the information provided at the time of booking is complete and accurate. If the actual waste type or volume differs significantly from the description provided, Waste Disposal Bermondsey may adjust the price, decline to collect certain items, or reschedule the collection.

4. Access and Customer Responsibilities

4.1 The Customer must ensure that Waste Disposal Bermondsey has safe, reasonable, and unobstructed access to the Site at the agreed time. This includes arranging parking permissions where required and ensuring that any gates, doors, or access routes are unlocked and free from obstruction.

4.2 If access to the Site is restricted, unsafe, or not as described at the time of booking, Waste Disposal Bermondsey may charge a wasted journey fee, reschedule the collection, or refuse to complete the Service.

4.3 The Customer must ensure that all waste to be collected is clearly identified, suitably bagged or contained where appropriate, and stored in a manner that is safe for collection staff to handle.

4.4 The Customer must not present for collection any items classified as hazardous or prohibited under applicable waste regulations, unless previously agreed and lawfully permitted.

5. Pricing and Payments

5.1 Prices are generally based on the type and estimated volume or weight of waste, the nature of the Site access, and the location within the service area. Any prices provided prior to inspection are estimates only and may be adjusted at the time of collection if the actual volume, weight, or nature of the waste differs from the original description.

5.2 Waste Disposal Bermondsey will confirm the final price before commencing the loading of waste. If the Customer does not agree to the final price, the Service will not proceed, and a call-out or cancellation fee may be charged where reasonable costs have been incurred.

5.3 Payment is typically required at the time of collection unless alternative arrangements have been agreed in advance. Waste Disposal Bermondsey accepts common payment methods such as cash, card, or bank transfer, subject to availability and any stated conditions.

5.4 For commercial Customers, Waste Disposal Bermondsey may, at its discretion, agree to invoice the Customer with specified payment terms. Late payments may incur interest and administrative charges in accordance with applicable UK law.

5.5 All prices are quoted exclusive of VAT unless otherwise stated. Where VAT applies, it will be added at the prevailing rate and shown clearly on any invoice or receipt.

6. Cancellations and Amendments

6.1 The Customer may cancel or amend a booking by giving reasonable notice prior to the scheduled collection time. The required notice period will be advised at the time of booking but will usually be at least one full working day.

6.2 If the Customer cancels a booking without the required notice, or is not present where their presence is necessary for access or payment, Waste Disposal Bermondsey may charge a cancellation or wasted journey fee to cover costs reasonably incurred.

6.3 Waste Disposal Bermondsey reserves the right to cancel or reschedule a booking due to events beyond its reasonable control, including but not limited to vehicle breakdowns, severe weather, road closures, staff illness, or compliance with regulations. In such cases, an alternative collection time will be offered where possible, and no additional charges will be applied solely due to the rescheduling.

6.4 If Waste Disposal Bermondsey arrives at the Site at the agreed time and is unable to carry out the collection due to the Customer’s failure to provide access or due to the presence of prohibited waste, the visit may be treated as a cancellation by the Customer and a fee may be charged.

7. Waste Regulations and Prohibited Items

7.1 Waste Disposal Bermondsey operates in accordance with applicable UK waste management legislation and regulations. All waste is transported and disposed of only at authorised facilities and in compliance with environmental and duty of care obligations.

7.2 The Customer is responsible for ensuring that waste presented for collection is lawful and does not include items that Waste Disposal Bermondsey is not permitted to handle. Prohibited waste may include, without limitation, asbestos, clinical or medical waste, certain chemicals, flammable or explosive materials, pressurised containers, and certain electrical or electronic items that require specialist handling.

7.3 Where the Customer presents prohibited or hazardous waste without prior agreement, Waste Disposal Bermondsey may refuse to collect it, remove only the compliant waste, or terminate the visit. The Customer may be liable for any costs incurred in safely managing or returning such items.

7.4 The Customer must provide any necessary information about the nature of the waste, including its composition, potential hazards, and any prior treatment, where relevant. Waste Disposal Bermondsey may request documentation or clarification to satisfy regulatory requirements.

7.5 For commercial Customers, duty of care waste transfer notes or other required documentation will be completed where applicable. The Customer must retain their copy of such documentation and ensure ongoing compliance with relevant regulations.

8. Service Performance and Timeframes

8.1 Waste Disposal Bermondsey will use reasonable endeavours to attend the Site and complete the collection within any agreed time window. However, collection times are estimates only and may be affected by traffic conditions, prior jobs, or unforeseen circumstances.

8.2 Waste Disposal Bermondsey will not be liable for minor delays that do not significantly affect the overall performance of the Service. Where delays are substantial, the Customer may be offered a revised time or alternative date.

8.3 The duration of each collection will depend on the volume and type of waste, access conditions, and any additional services requested. The Customer must ensure that any necessary permissions for parking and loading are available for a sufficient period.

9. Damage, Liability, and Insurance

9.1 Waste Disposal Bermondsey will take reasonable care when carrying out the Service to avoid causing damage to property. However, the Customer acknowledges that waste collection involves manual handling, vehicle movement, and the removal of bulky items, which may pose a risk to surfaces or fixtures, particularly where access is tight or unsuitable.

9.2 The Customer must inform Waste Disposal Bermondsey of any fragile surfaces, concealed services, or other particular risks at the Site. Where the Customer requests that collection staff move items through a tight or restricted area, any damage arising from such access may be at the Customer’s risk.

9.3 Waste Disposal Bermondsey’s liability for any loss or damage arising from the Service is limited to losses that are a foreseeable and direct result of our breach of these Terms and Conditions or our negligence. Waste Disposal Bermondsey will not be liable for indirect, consequential, or economic losses, loss of profit, loss of business, or loss of opportunity.

9.4 Nothing in these Terms and Conditions excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be excluded under UK law.

9.5 Waste Disposal Bermondsey maintains appropriate insurance cover in respect of its legal liabilities. Details of insurance may be provided on request.

10. Customer Indemnity

10.1 The Customer agrees to indemnify Waste Disposal Bermondsey against any claims, losses, damages, or expenses arising from:

a. the Customer’s failure to comply with these Terms and Conditions

b. the inclusion of prohibited or hazardous items within the waste

c. any inaccuracies in information provided about the waste or the Site

d. any third-party claims arising from the Customer’s breach of duty of care in relation to waste.

11. Complaints and Dispute Resolution

11.1 If the Customer is dissatisfied with any aspect of the Service, they should notify Waste Disposal Bermondsey as soon as reasonably possible, providing full details of the issue and any supporting information.

11.2 Waste Disposal Bermondsey will investigate complaints promptly and aim to reach a fair resolution, which may include repeating the Service, providing a partial refund, or taking other appropriate steps, depending on the circumstances.

11.3 If a dispute cannot be resolved directly, the parties may consider mediation or other forms of alternative dispute resolution before pursuing court proceedings, where appropriate.

12. Variations to Terms

12.1 Waste Disposal Bermondsey may update or amend these Terms and Conditions from time to time. The version in force at the time of your booking will apply to that particular Service.

12.2 Any changes that materially affect the Customer’s rights will be notified where legally required. Continued use of the Service following any update to the Terms and Conditions will constitute acceptance of the revised terms.

13. Data Protection and Privacy

13.1 Waste Disposal Bermondsey will collect and process personal data provided by the Customer for the purposes of administering bookings, delivering services, processing payments, and fulfilling legal obligations.

13.2 Personal data will be handled in accordance with applicable UK data protection laws. Information will not be sold to third parties and will only be shared where necessary for service delivery, compliance, or legal reasons.

14. Governing Law and Jurisdiction

14.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them, are governed by and construed in accordance with the laws of England and Wales.

14.2 The courts of England and Wales will have exclusive jurisdiction to settle any dispute or claim arising from or related to these Terms and Conditions or the provision of waste collection and disposal services by Waste Disposal Bermondsey.

15. General Provisions

15.1 If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, illegal, or unenforceable, that provision shall be deemed modified to the minimum extent necessary to make it valid, legal, and enforceable. The remaining provisions shall continue in full force and effect.

15.2 No failure or delay by Waste Disposal Bermondsey in exercising any right or remedy under these Terms and Conditions shall operate as a waiver of that right or remedy.

15.3 The Agreement is between Waste Disposal Bermondsey and the Customer. No other person shall have any rights to enforce any of its terms.

15.4 These Terms and Conditions constitute the entire agreement between the parties in relation to the Service and supersede any prior agreements, understandings, or arrangements, whether oral or written.
